Legacy Modular Homes LLC
Terms of Use
Effective Date: September 6, 2026
These Terms of Use (“Terms”) govern your access to and use of legacymodularhome.com and the online forms, scheduling tools, information, features, and other website services made available by Legacy Modular Homes LLC (“Legacy,” “we,” “us,” or “our”).
By accessing or using the website, you agree to these Terms. If you do not agree, please do not use the website.
Acceptance of Terms
By visiting, browsing, using, or submitting information through this website, you acknowledge that you have read and agree to be bound by these Terms and our Privacy Policy.
If you use the website on behalf of a company, organization, trust, partnership, or other entity, you represent that you have authority to act on its behalf in connection with your website use.
These Terms apply only to use of this website and do not replace the terms of any separate written agreement you may enter into with Legacy.
Website Purpose and Informational Use
The website provides general information about Legacy, modular-home construction, potential home styles, project coordination, consultation opportunities, and related services.
Website content is provided for general informational purposes only. It is not architectural, engineering, legal, lending, insurance, zoning, building-code, permitting, tax, environmental, surveying, or other professional advice. Property conditions and project requirements vary, and information that may be appropriate for one project may not apply to another.
You are responsible for obtaining appropriate property-specific guidance from qualified professionals and governmental authorities before making decisions relating to land acquisition, design, financing, permitting, construction, or any other project matter.
No Contractor-Client Relationship
Using the website, requesting a consultation, scheduling a meeting, submitting project information, uploading documents, receiving a response, or discussing a potential project does not create a contractor-client relationship, fiduciary relationship, agency relationship, partnership, joint venture, or other contractual relationship with Legacy.
Legacy is not obligated to accept, evaluate, estimate, bid, finance, design, permit, manage, or perform any project merely because information has been submitted through the website.
A binding construction or professional-services relationship exists only when the applicable parties enter into a separate written agreement. That signed agreement will control the scope, price, responsibilities, schedule, payment terms, warranties, change procedures, and other project-specific obligations.
Project Information, Estimates, and Availability
Any project descriptions, examples, photographs, floor plans, home styles, dimensions, timelines, price ranges, preliminary budgets, cost discussions, or other information shown on the website or provided in an initial consultation are illustrative or preliminary unless expressly incorporated into a signed written agreement.
Actual project requirements, cost, timing, and feasibility may be affected by factors that include:
- Property location, access, topography, soils, drainage, utilities, and existing conditions
- Zoning, setbacks, flood requirements, building codes, permitting, inspections, and municipal approvals
- Architectural and engineering requirements
- Manufacturer capacity, plan availability, material selections, and product lead times
- Transportation routes, crane access, module setting requirements, and site logistics
- Labor, subcontractor, supplier, and material availability
- Financing, insurance, title, survey, environmental, and other third-party requirements
- Weather, governmental action, market conditions, and other circumstances outside Legacy’s reasonable control
Legacy may change, add, suspend, or discontinue website information, service areas, home options, scheduling availability, or offered services at any time. Nothing on the website constitutes a binding offer or guarantee that a particular project, design, price, schedule, product, manufacturer, professional, or service will be available.
Permitted Use
You may use the website for lawful, personal, and legitimate business purposes related to learning about Legacy and evaluating whether Legacy’s services may be appropriate for a potential project.
Subject to these Terms, you may view, download, or print reasonable portions of publicly available website content for your own noncommercial reference. This limited permission does not transfer ownership of any website content or intellectual-property rights to you.
Prohibited Use
You may not use the website to:
- Violate any applicable law, regulation, court order, or third-party right
- Transmit malware, malicious code, destructive files, or material intended to interfere with website operation
- Attempt to gain unauthorized access to the website, hosting environment, forms, accounts, databases, or connected systems
- Probe, scan, test, bypass, disable, or defeat security or access-control measures without authorization
- Impersonate another person or misrepresent your identity, authority, affiliation, or relationship with Legacy
- Harvest or collect personal information about others without lawful authorization
- Use automated tools to scrape or extract website content at a scale or in a manner that materially burdens the website or circumvents reasonable technical controls
- Copy, publish, distribute, modify, sell, license, or commercially exploit website content except as expressly permitted by Legacy or applicable law
- Use Legacy’s name, branding, photographs, plans, website content, or other materials to falsely suggest sponsorship, endorsement, partnership, or authorization
- Upload or submit content that is unlawful, fraudulent, defamatory, infringing, malicious, or that you do not have the right to provide
We may restrict or block website access when reasonably necessary to protect the website, Legacy, our clients, third parties, or the security and integrity of our systems.
User Submissions and Uploaded Materials
The website may allow you to provide project descriptions, property information, plans, surveys, photographs, floor plans, inspiration images, documents, or other materials (“User Submissions”).
You retain any ownership rights you may have in your User Submissions. By submitting materials to Legacy, you represent that you have the right and authority to provide them and to permit Legacy to use them for the purposes described below.
You grant Legacy a nonexclusive, limited right to receive, host, store, reproduce, review, organize, and share your User Submissions only as reasonably necessary to:
- Respond to your inquiry
- Evaluate a potential project
- Communicate with you about requested services
- Coordinate with service providers or project professionals when reasonably necessary and authorized
- Perform services under a separate written agreement if you later engage Legacy
- Maintain appropriate business, legal, security, and recordkeeping functions
This limited permission does not transfer ownership of your User Submissions to Legacy.
Do not submit Social Security numbers, bank-account information, payment-card information, medical records, passwords, or other highly sensitive information through the website. Do not submit confidential third-party documents unless you are authorized to provide them.
Intellectual Property
Unless otherwise indicated, the website and its original text, graphics, layout, branding, logos, design elements, interfaces, and other content are owned by or licensed to Legacy and are protected by applicable intellectual-property laws.
Some photographs, floor plans, manufacturer materials, trademarks, or other content may be owned by third parties and used by Legacy with permission, attribution, license, or other lawful authorization. Third-party ownership is not transferred to you.
You may not use Legacy’s trademarks, service marks, logos, or branding in a manner that suggests sponsorship, approval, affiliation, or endorsement without prior written permission.
Nothing in these Terms transfers ownership of your own User Submissions to Legacy or transfers Legacy’s website intellectual property to you.
Third-Party Services and Links
The website may use or link to third-party services such as scheduling platforms, mapping services, email providers, hosting services, analytics tools, file-storage providers, social-media services, manufacturers, or other websites.
Third-party services are controlled by their respective providers and may be subject to separate terms, privacy policies, availability rules, and security practices. Legacy does not control and is not responsible for the content, policies, security, availability, accuracy, or operation of third-party services.
A link to a third-party website or service is provided for convenience and does not by itself constitute an endorsement, guarantee, partnership, or representation concerning that third party.
Privacy
Our collection, use, disclosure, and protection of personal information obtained through the website are described in our Privacy Policy, which is incorporated into these Terms by reference for purposes of your website use.
Please review the Privacy Policy before submitting personal information, property information, documents, photographs, plans, or other materials through the website.
Text Messages, Telephone Calls, and Email
If you request contact from Legacy or submit contact information through the website, you authorize us to respond using the telephone number, email address, or other contact information you provide for purposes related to your inquiry or an existing business relationship.
Text-message consent is voluntary and is not a condition of purchasing services. Message and data rates may apply. You may opt out of text messages by replying STOP or otherwise informing us that you no longer wish to receive texts.
You may ask us to stop marketing emails by using the unsubscribe instructions in a marketing message or by contacting us. This does not prevent Legacy from sending communications relating to an active inquiry, existing project, contract, payment, safety matter, legal obligation, or other ongoing business relationship.
Email and text-message systems are not guaranteed to be secure, uninterrupted, or delivered without delay. For urgent project or safety matters, use an appropriate direct communication method.
Disclaimers
To the fullest extent permitted by applicable law, the website and its content are provided on an “as is” and “as available” basis. Legacy does not warrant that the website will be uninterrupted, error-free, completely secure, or free from harmful components.
Legacy makes reasonable efforts to present useful information, but we do not guarantee that website content is complete, current, accurate, suitable for a particular property, or sufficient for making construction, real-estate, financing, design, permitting, or other project decisions.
Plans, specifications, dimensions, pricing, schedules, materials, products, photographs, renderings, examples, and manufacturer information should be independently confirmed as applicable to your specific project before reliance.
Nothing in this section limits any express warranty, responsibility, or obligation that Legacy separately agrees to in a signed construction or professional-services agreement. Project-specific rights and remedies will be governed by that agreement and applicable law.
Limitation of Liability
To the fullest extent permitted by applicable law, Legacy and its owners, officers, employees, representatives, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from your access to, inability to access, or use of the website or third-party services linked from the website.
This website limitation does not govern liability arising from construction or other services performed under a separate written agreement. Any such liability will be determined under the applicable agreement and law.
Nothing in these Terms excludes or limits liability, rights, warranties, or remedies that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Legacy and its owners, officers, employees, representatives, and agents from third-party claims, damages, liabilities, costs, and reasonable expenses arising from:
- Your unlawful or malicious misuse of the website
- Your material violation of these Terms
- Your infringement or violation of another person’s intellectual-property, privacy, confidentiality, or other legal rights through materials you submit
- Your submission of content that you did not have lawful authority to provide
This indemnification obligation does not apply to the extent a claim results from Legacy’s own negligence, willful misconduct, or other conduct for which indemnification may not lawfully be required.
Governing Law and Venue
These website Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.
Subject to any mandatory legal requirements, disputes arising specifically from these website Terms or website use may be brought in the state courts located in Monmouth County, New Jersey, or the federal courts having jurisdiction over that area, and the parties consent to the jurisdiction of those courts for such disputes.
This section does not replace any dispute-resolution, venue, governing-law, or claims provisions contained in a separate written project agreement with Legacy. If a signed project agreement applies to a dispute, that agreement will govern according to its terms and applicable law.
Changes to These Terms; Severability
Changes to These Terms
We may update these Terms to reflect changes in the website, services, business practices, technology, or legal requirements. The revised Terms will be posted on this page with an updated effective date.
Your continued use of the website after revised Terms are posted constitutes acceptance of the revised Terms to the extent permitted by applicable law.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed without affecting the remaining provisions.
No Waiver
Legacy’s failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
